United States District Court, D. Utah
Dec 23, 2003
Case No. 2:03CR 0262DKW (D. Utah Dec. 23, 2003)

Opinion

Case No. 2:03CR 0262DKW

December 23, 2003

ORDER

Based upon the motion of the parties to continue the trial date in this matter and for good cause appearing,

IT IS HEREBY ORDERED:

1. The two-day jury trial currently set for December 15, 2003, is stricken;

2. A two-day jury trial will begin on February 26, 2004, at 8:30 a.m.;

3. For the reasons stated in the parties' motion, the Court finds that the ends of justice served by granting the requested continuance outweigh the best interest of the public and the defendant in a speedy trial and therefore, the time from the stricken trial date to the new trial date is excluded from the computation of time required under the Speedy Trial Act, pursuant to 18 U.S.C. § 3161(h)(1)(I) and (h)(8)(A).
