ORDER
THIS CAUSE is before the court on Sameeh Hammoudeh's Motion and Memorandum in Support for Inclusion of Participation in Investigative Expert and Other Services by Defendant Not Represented by CJA Counsel (Doc. 292) and the government's response in opposition (Doc. 317). A hearing was conducted on the motion October 10, 2003. In addition to counsel for Mr. Hammoudeh and counsel for the government, FPD Fletcher Peacock also participated in the hearing. For reasons more thoroughly addressed at the hearing, Mr. Hammoudeh's motion is DENED without prejudice. Should Mr. Hammoudeh decide to seek assistance pursuant to the Criminal Justice Act, it will be necessary to establish his right to such assistance. Although this court has previously determined that he was indigent, intervening circumstances suggest otherwise. In addition to establishing his rights to such assistance, Mr. Hammoudeh should specifically identify the assistance sought and the costs of such assistance to the best of his ability.
