ORDER


Presently before the court are the following: (1) "Motion for Reconsideration for Notice of Appeal and Waiver of Docketing Fee and Filing Fee;" and (2) an application to proceed on appeal in forma pauperis.

(1) The United States Court of Appeals has notified Mr. Goode that he failed to submit a docketing statement as required by 7TH CIR. R. 3(c)(1). This failure may result in a $100 fine or even dismissal of the appeal. See 7TH CIR. R. 3(c)(2). Since the district court has no power to meddle in the docket management of the court of appeals, the court must DENY this motion for WANT OF JURISDICTION.

(2) The court DENIES the application to proceed in forma pauperis on account of Mr. Goode's financial wherewithal. Having become intimately familiar with Mr. Goode's case over the past two years, it is clear to the court that Mr. Goode has substantial financial resources at his disposal.

Mr. Goode owns numerous residences, and receives thousands of dollars in rental income each month.

In accordance with FED.R.APP.P. 24(a)(4)(A), the Clerk is hereby DIRECTED to "immediately notify the parties and the court of appeals" that this court has denied Mr. Goode's application to proceed in forma pauperis.

SO ORDERED.
