ORDER


Based on stipulation of the plaintiff and the defendant, the court enters the following;

ORDER

It is hereby ORDERED that the trial date of Monday, January 5, 2004, be stricken and the trial continued to the ___ day of ___ 2004.

It is further, ORDERED that the time from January 5, 2004 until the time of the trial is excluded for purposes of speedy trial and the Court finds, pursuant to 18 U.S.C. § 3161 (h)(8)(A) and (B) that the ends of justice served in this action outweigh the best interest of the public and the defendant in a speedy trial.
