January 6, 2010.

James Lee. Turner, Assistant U.S. Attorney, U.S. Attorney's Office, Houston, TX, for Plaintiff-Appellee.

Appeal from the United States District Court for the Southern District of Texas, USDC No. 5:08-CR-2051-1.

Before GARZA, CLEMENT, and OWEN, Circuit Judges.

The attorney appointed to represent Carlos Garcia has moved for leave to with draw and has filed a brief in accordance with Anders v. California, 386 U.S. 738, 87 S.Ct. 1396, 18 L.Ed.2d 493 (1967).
