ORDER (First request)


Upon Defendant's Motion to Continue Admit/Deny Hearing (first request), and there being no objection from the government, and for good cause appearing, to wit: defense counsel not available 5/30/06 through 6/2/06,

IT IS HEREBY ORDERED granting Defendant's Motion to Continue Admit/Deny Hearing.

IT IS ORDERED continuing the Admit/Deny Hearing on Petition on Supervised Release from May 30, 2006 to Monday, June 5, 2006 at 1:30 p.m.

This court specifically finds that the ends of justice served by taking this action outweigh the best interest of the public and the defendant in a speedy disposition. This finding is based on the court's conclusion that the failure to grant such a continuance would unreasonably deny the defendant continuity of counsel and would deny the attorney for defendant the reasonable time necessary for effective preparation, taking into account the exercise of due diligence. 18 U.S.C. § 3161(h)(8)(b)(IV). IT IS FURTHER ORDERED that excludable delay under Title 18 U.S.C. § 3161(h) will commence on 5/24/06, for a total of 0 days.
