ORDER


This matter came before United States District Judge J. Thomas Greene for a Status and Scheduling Conference on May 13, 2003 with Kirk C. Lusty, Special Assistant United States Attorney, representing the United States and Joseph Jardine representing the defendant Claude A. Fratto. At that hearing, Mr. Jardine informed the Court that his client was attempting to locate various documents necessary for Mr. Fratto's defense and that as a result he would be filing a motion for extension of time under the Federal Speedy Trial Act. Based upon Mr. Jardine's representation, the Court set the following dates:

1. All motions are to be filed by July 15, 2003; and

2. Trial is set to begin on September 8, 2003 at 9:00 a.m. In the event that a separate criminal case that is set for trial on September 8, 2003 ahead of this case on the Court's calendar does not settle, then trial will begin in the above-entitled action on September 15, 2003 at 9:00 a.m.
