ORDER DENYING MOTION TO SUPPRESS


The defendant, Jorge Esparza-Mendoza has been charged in a one-count indictment with illegal reentry by a previously removed alien. Esparza-Mendoza filed a motion to suppress evidence, alleging that his Fourth Amendment rights were violated. The Court held an evidentiary hearing on this motion on February 4, 2003, and received the final supplemental briefing on April 8, 2003. The court hereby rules the motion to suppress is DENIED on the standing argument advanced by the government. The court's opinion will follow within three weeks.

The plea cut-off date is June 9, 2003, and this matter is set for trial on June 23, 2003. SO ORDERED.
