ORDER


Defendant's May 25, 2007 letter request (attached) for extension of the June 4, 2007 voluntary surrender date is GRANTED as follows: the surrender date is extended to Thursday, June 28, 2007. There will be no further extensions.

Dear Hon. Richard Kyle:

This letter is to request a further extension of Mr. Ennen's voluntary surrender date of June 4, 2007, due to his current medical condition.

I received a letter from Dr. Keating dated May 21, 2007, which details Mr. Ennen's medical condition relating to kidney stones and the course of treatment required to remove the stones from both kidneys. As Dr. Keating indicates, treatment of Mr. Ennen's right kidney will not occur before June 4, 2007, to allow his body to recover from treatment of his left kidney.

Although Dr. Keating does not indicate how long recovery will take, I suspect that a voluntary surrender date approximately six weeks from June 4, 2007, would suffice.

As Dr. Keating indicates, if you have any questions you can contact him at the telephone number identified in his letter, which is included with this letter.

To Whom it May Concern

The above named patient has a current diagnosis of left and right kidney stones all of which need treatment. Currently the patient has had two attempts to remove a very large hard solid stag horn stone from his left kidney. He will be undergoing his last manipulation, treatment and hospital admission for this left stone on 5/25/2007 at the St. Cloud Hospital. The patient will then begin manipulation and treatment on his right kidney stone with Extracorporeal Shockwave Lithotripsy. This treatment for his right stone will not happen any time sooner than June 4, 2007 to allow his body to recover from the previous kidney manipulation on the left side. This patient will be admitted to the St Cloud Hospital for one day post surgery.

This patient has multiple stone problems that are being treated and it would be in the patients best interest if his stone condition was under control or resolved before he was incarcerated. I would like you to consider deferring this patients incarceration date until his right kidney stones are fully treated.
