RULING


The defendants have filed a motion for notice of changes to the record. The Court responds as follows:

Rec. Doc. No. 1737.

All documents and pleadings currently under seal will remain under seal. Since an appeal has been taken, the Court's work in this case is complete. The Court will not review any documents, transcripts, or other pleadings now under seal to determine whether they should be filed in the public record. The Clerk of Court has already provided the parties with a log of sealed documents. The parties may request from the Clerk updated copies of the sealed log as needed. The Court has already disclosed to the parties those documents which were filed in the public record which may have originally been filed under seal.

All official transcripts prepared and certified by the court reporters have been filed AS PREPARED by the court reporters either in the public record or under seal. For reasons previously given, some transcripts had to be redacted to protect the names of jurors or to protect privileged or private information. When the Court did file redacted transcripts in the public record, the official transcript was filed as prepared by the court reporter under seal. The parties have already been provided with this information.

The Clerk of Court and the court reporters have the responsibility for the preparation of the transcript and record for appeal. The court reporters have the sole responsibility of preparing a complete and accurate transcript of all proceedings in accordance with the Rules of the Fifth Circuit Court of Appeals and the Judicial Conference of the United States. The Clerk of Court will prepare the record for appeal in accordance with the Rules of the Fifth Circuit.

Therefore, defendants' motion for notice of any changes made to the record is moot.
