United States Court of Appeals, Eleventh Circuit
Feb 6, 2009
310 F. App'x 355 (11th Cir. 2009)

Opinion

No. 07-12544 Non-Argument Calendar.

February 6, 2009.

Anne R. Schultz, U.S. Attorney's Office, Miami, FL, for Plaintiff-Appellee.

Robert David Malove, Robert David Malove, P.A., FT Lauderdale, FL, for Defendant-Appellant.

Appeal from the United States District Court for the Southern District of Florida. D.C. Docket No. 06-20714-CR-UUB.

Before MARCUS, PRYOR and ANDERSON, Circuit Judges.

Robert David Malove, appointed counsel for Dick Hermanski Dixon-Brounfield in this direct criminal appeal, has moved to withdraw from further representation of the appellant and filed a brief pursuant to Anders v. California, 386 U.S. 738, 87 S.Ct. 1396, 18 L.Ed.2d 493 (1967). Our independent review of the entire record reveals that counsel's assessment of the relative merit of the appeal is correct. Because independent examination of the entire record reveals no arguable issues of merit, counsel's motion to withdraw is GRANTED, and Hermanski's convictions and sentences are AFFIRMED.
