ORDER FOR PSYCHOLOGICAL AND PSYCHIATRIC EXAMINATION AND REPORT
This case came before the Court on May 16, 2003; Mark K. Vincent, Assistant United State Attorney, appeared for the United States; defendant appeared in person and was represented by his counsel L. Clark Donaldson. At the hearing on May 16, 2003, and based upon defendant's recent suicide attempt, the United States advised the Magistrate Judge that it would be filing the attached motion requesting that the Court order that a psychological and psychiatric examination be performed. The Court, having fully considered the matter,
IT IS HEREBY ORDERED that a pretrial psychiatric and/or psychological examination, as provided for in 18 U.S.C. § 4241 (a), be conducted to determine the mental competence of the defendant. Specifically, the Court ORDERS that, pursuant to 18 U.S.C. § 4247 (b), the defendant be committed to the custody of the United States Attorney General, United States Bureau of Prisons, for a reasonable period, but not to exceed thirty (30) days, for placement in a suitable facility for the purposes of a pretrial psychiatric and/or psychological examination. Specifically, the Court recommends that the pretrial psychiatric and/or psychological examination take place at the Federal Bureau of Prisons, Federal Medical Center in Springfield, Missouri, by appropriate personnel.
The Court ORDERS that, pursuant to 18 U.S.C. § 4247 (c), a psychiatric and/or psychological report be filed with the Court,
The Court ORDERS the United States Attorney to pay for this pretrial psychiatric and psychological examination.
Finally, the Court ORDERS that Speedy Trial time be tolled from the signing of this Order until a hearing is held to determine his mental competency upon his return from his psychiatric and/or psychological examination, pursuant to 18 U.S.C. § 3161 (h)(1)(a) and 4247(b).
