Opinion

Case No. 2:03-CR-0049B

May 12, 2003

ORDER

Before the Court is defendant's April 29, 2003 motion for review of detention. Defendant requests this Court to reconsider its April 8, 2003 decision to detain defendant pending sentencing. Specifically, defendant seeks to be released from detention in order to make the necessary arrangements for the operation of his business in the event he is incarcerated for his offense in the present case.

The government filed a response to defendant's motion for review of detention on May 12, 2003. The government argues against releasing defendant based on his continued violations of his pre-trial release conditions, including repeated positive tests for drug use.

For the reasons set forth in the government's response, the Court DENIES defendant's motion for review of detention [23-1].
