MOTION AND ORDER TO DISMISS


The United States requests leave of court to dismiss this case. Fed.R.Crim.P. 48(a). It appears from an interview and a document that the firearm at issue in this case belonged to a person other than the Defendant. Further, it appears that the evidence of joint possession would probably be insufficient to obtain and sustain a conviction. See U.S.A.M. 9-27.220.

IT IS SO ORDERED.
