ORDER


THE COURT, having reviewed and critically considered the Government's Motion for Leave to Dismiss Indictment, and being otherwise fully advised, finds that the government has stated sufficient reasons and explanation to support dismissal of the indictment filed against the defendant for good cause. The Court, therefore HEREBY ORDERS:

The government's Motion for Leave to Dismiss Indictment is GRANTED. The Indictment filed against Timothy Gordon Cassius on December 22, 2005, in the case at bar is hereby DISMISSED WITHOUT PREJUDICE.
