ORDER SETTING STATUS CONFERENCE RE: BOYCES' MOTION TO STAY EXECUTION


This matter came on regularly for a hearing on Defendants James M. Boyces, Jr., a.k.a. James M. Boyce and Shelley A. Boyce's Motion for Order Staying Order and Judgment Pending Appeal and/or Fixing Amount of Supersedeas Bond. Henry C. Darmstadter, of the U.S. Department of Justice Tax Division appeared for Plaintiff United States, and Richard Shepard of the Shepard Law Offices appeared for the Boyces.

Counsel have represented they are close to reaching a stipulation regarding this motion, and believe that a stipulation or proposed dispositive order will be forthcoming in the next few weeks. Accordingly, good cause appearing, IT IS HEREBY ORDERED that the parties shall submit a stipulation or other proposed dispositive order on or before Monday, July 16, 2001. If the parties fail to submit such a document by July 16, 2001, counsel shall appear for a status conference before this Court on August 6, 2001, at 10:30 a.m.

IT IS SO ORDERED.
