ORDER TO CLERK FOR DISBURSEMENT OF FUNDS


This matter is before the court on the "United States' Motion for Additional Disbursement of Sales Proceeds" filed September 13, 2000. Although Defendants Wanda R. Bowman and Harry Bowman have filed quite a few documents subsequent to September 13, 2000, there is nothing in those documents which states a legal or factual reason why the relief which plaintiff requests should not be granted. Indeed, as plaintiff observes, both Wanda and Harry Bowman sent a letter to this court claiming that Harry Bowman owned a one-half interest in the real property which produced the proceeds, a portion of which are in this court's registry. Plaintiff has also submitted sworn declarations demonstrating that Harry Bowman is indebted to plaintiff in a sum which exceeds the value of his one-half interest in the property. It further appears that plaintiff has taken all procedural steps necessary to perfect its claim to the proceeds. Accordingly, it is

ORDERED as follows:

1. The referenced motion (#122) is GRANTED.

2. The clerk of the court shall forthwith disburse to plaintiff the sum of $64,357.37 of the funds currently held in the registry of the court to the United States.
