ORDER REINSTATING JUDGMENT OF CONVICTION


This matter came before the Court on June 16, 2004, for a status hearing. The United States was represented by Assistant United States Attorney Elizabethanne C. Stevens. The defendant, Ramey Clyde Barbieri, was not present but was represented by his attorney, Mark Moffat.

The Defendant, through his counsel, has informed the Court that he has elected not to withdraw his conditional plea of guilt which was the subject of the August 16, 2002 Order and Judgment, and resulting Mandate, from the United States Court of Appeals for the Tenth Circuit.

THEREFORE, IT IS HEREBY ORDERED that Ramey Clyde Barbieri's judgment of conviction, previously entered on December 10, 2001, is reinstated.
