OPINION


Yesterday defendant filed a motion to dismiss Counts Five and Six of the indictment insofar as they allege violation of 18 U.S.C. § 666. The Government has responded today, opposing the motion, and defendant has filed a reply.

The trial is scheduled to commence next Monday, May 21. Consequently the motion must be disposed of immediately. Under the circumstances the court will not undertake an opinion at this time. However, the court has determined that the motion should be denied.

SO ORDERED.
