ORDER


The defendant in the above-styled matter, filed on or about August 19, 2005, a motion to modify his term of imprisonment pursuant to 18 U.S.C. § 3582(c)(2).

The defendant has also filed a motion to disqualify the undersigned.

The Government has filed responses to both the motion to modify the term of imprisonment as well as the motion seeking disqualification of the undersigned.

For the reasons set forth in the Government's response, the defendant's motion requesting disqualification is hereby DENIED.

For the reasons set forth in the Government's response, the defendant's motion seeking to modify his term of imprisonment is hereby OVERRULED AND DENIED.

SO ORDERED.
