that the Court finds for the Defendant, United States Fidelity Guaranty Company, and that Plaintiff is not entitled to recover under the Miller Act against said defendant; and it is further

ORDERED AND ADJUDGED that Kimberly Concrete is not a part of this civil action because it was previously discharged in bankruptcy; and it is further

ORDERED that this civil action be dismissed and stricken from the active docket of this Court.
