MEMORANDUM OF DECISION RE MOTION FOR SUMMARY JUDGMENT (102.00)
The plaintiff has sued the defendant Belizaire to collect $1,662.43, the allegedly unpaid amount accrued by the defendant on a Chase Bank credit card through August 31, 2008, along with 24% interest on that amount. In her answer Belizaire admitted there was an agreement, through the use of the credit card, to pay accrued charges.
The plaintiff has moved for summary judgment and has submitted evidence it is the assignee of the Chase card, an affidavit of debt in the alleged amount, and copies of monthly statements showing the amount due and mailed to Belizaire's address. The defendant has filed no opposition papers.
Applying the well recognized standards for granting or denying summary judgment motions, the court finds there are no material facts in dispute, and that the plaintiff is entitled to judgment in the amount of $1,662.43 plus attorneys fees of 15% of $249.36, plus costs of $215.59. See Citibank (South Dakota) v. Manger, 105 Conn.App. 764 (2008); Credit One, LLC v. Head, 117 Conn.App. 92 (2009).
Judgment shall enter accordingly with postjudgment interest to accrue at 6% per annum.
