Defendant, David Lopez, having moved (1) pursuant to CPLR 5704(a) for an order granting a temporary stay of enforcement of a foreclosure judgment, denied by a Justice of the Supreme Court, Bronx County, in an order to show cause granted on September 6, 2019, pending the adjudication by the Supreme Court of his motion to vacate that judgment, and/or (2) permission to appeal to this Court pursuant to CPLR 5701(c), Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is denied.
