Opinion
No. 84-178.
October 2, 1984.
Appeal from Circuit Court, Dade County; Joseph J. Gersten, Judge.
Carey, Dwyer, Cole, Echart, Mason Spring and Harriet Lewis, Miami, for appellant.
Pyszka Kessler and William M. Douberley, Miami, for appellee.
Before SCHWARTZ, C.J., and HUBBART and FERGUSON, JJ.
Affirmed. See Federal Insurance Co. v. Applestein, 377 So.2d 229 (Fla. 3d DCA 1979) (insurer's duty to defend an action against its putative insured is determined by the allegations of the plaintiff's complaint); Cloud v. Shelby Mutual Insurance Co. of Shelby, Ohio, 248 So.2d 217 (Fla. 3d DCA 1971) (coverage is not excluded as a matter of law where there was an "intentional act" but not an "intentionally caused" injury).
