Opinion

Case No. 1D02-0848; 02-0851.

Opinion filed March 27, 2003. Rehearing denied April 29, 2003.

An appeal from the Circuit Court for Duval County. Jean M. Johnson, Judge.

Arthur J. England, Jr.; Paul C. Savage; Julissa Rodriguez of Greenberg Traurig, P.A., Miami and Brian E. Currie of Taylor, Day Currie, Jacksonville, for appellants.

Joel D. Eaton of Podhurst, Orseck, Josefsberg, Eaton, Meadow, Olin Perwin, P.A., Miami; Anderson Howell, P.A.; Milton, Leach, Whitman, D'Andrea, Charek Milton, P.A.; and Harrell Johnson, P.A., Jacksonville, for appellee.

We affirm as to all issues raised on appeal. Pursuant to our opinion inLewis v. Bondy, 752 So.2d 1225 (Fla. 1st DCA 2000), we affirm the trial court's use of a multiplier in determining attorney's fees under the offer of judgment statute; however, we note conflict with Allstate Ins. Co. v. Sarkis, 809 So.2d 6 (Fla. 5th DCA 2001) (en banc), review granted, 826 So.2d 992 (Fla. 2002).

BOOTH, WOLF and KAHN, JJ., CONCUR.
