GARNISHEE ORDER TO PAY

Hon. David M. Lawson, United States District Judge

This matter is before the Court upon the Application of the United States for a Writ of Garnishment (ECF No. 1). The writ of garnishment was issued by the Court on March 18, 2022 and served on all parties on March 29, 2022. (ECF Nos. 2, 3). The garnishee filed its answer stating that Vanover was an active employee, entitled to receive wages on a bi-weekly basis. (ECF No. 4) Vanover filed his request for a hearing, seeking a voluntary payment plan. (ECF No.5) The matter was referred to the Magistrate Judge for hearing and issuance of a report and recommendation.

The court set May 26, 2022 as the date for a hearing on the objection to the garnishment. The parties met prior to the start of the hearing and reached a mutually satisfactory resolution. The terms of the agreement were placed on the record, with Curtis Vanover expressing his agreement to the terms as set forth below.

After review of the record, IT IS ORDERED that from the date of the receipt of the writ of garnishment, which date is April 6, 2022, Ford Motor Company, shall withhold 15% of Curtis Vanover's net earnings (including salary, commission, bonus or other pay) in accordance with the provisions of 15 U.S.C. § 1673(a); and

IT IS FURTHER ORDERED that the funds so withheld shall be promptly remitted to Clerk of the Court (USDC-EDMI), Attn: Financial, 231 W. Lafayette, Detroit, MI 48226, with the payment made payable to the United States;

IT IS FURTHER ORDERED that the Clerk of the Court shall distribute said funds in accordance with the provision of the judgment in Case No. 18CR20464 and;

IT IS FURTHER ORDERED that this garnishment shall remain in place until such time as the garnishee no longer has custody or control of any funds belonging to Curtis Vanover, the judgment is paid in full or upon further order of the Court.
