ORDER

Defendant-Appellant William Ray Turner has filed a Motion for Voluntary Dismissal under Fed. R. App. P. 42 that satisfies the requirements of 10th Cir. R. 42.3. The motion to dismiss is granted. The government's motion to enforce the appellate waiver in the plea agreement is denied as moot. The appeal is DISMISSED. A copy of this order shall stand as and for the mandate of the court.
