On September 2, 2022, the Court received a letter dated August 29, 2022, from defendant Terrance Rose. The letter will be separately docketed. Defendant requests that the Court appoint him an attorney so he may file a motion pursuant to 28 U.S.C. § 2255 to vacate, set aside, or correct his sentence. He also requests that the Court send him a copy of United States v. Taylor, 142 S.Ct. 2015 (2022).
On February 22, 2022, defendant was sentenced following his guilty plea. The formal Judgment was entered on February 23, 2022. The criminal case is now closed. Thus, there is no pending proceeding for which the Court could appoint counsel. As such, defendant's request for an attorney is DENIED WITHOUT PREJUDICE.
If defendant wishes to file a motion pursuant to 28 U.S.C. § 2255, he may do so. If he does so, he is not automatically entitled to the appointment of an attorney, although of course he can retain his own attorney. If defendant files a Section 2255 motion, he may request the appointment of an attorney pursuant to 18 U.S.C. § 3006A(a)(2)(B). Attached hereto is the form defendant should use if he wishes to file a Section 2255 motion.
Defendant's request that the Court send him a copy of United States v. Taylor is DENIED. The Court cannot provide legal advice or legal materials to any party in a case.
