CONSENT TO REVOCATION OF SUPERVISED RELEASE AND WAIVER OF RIGHT TO BE PRESENT AND SPEAK AT SENTENCING AND TO OBJECT TO RECOMMENDATION OF U.S. MAGISTRATE JUDGE
I, Jose Camillo Pineda, have been charged with violating my conditions of supervised release. A United States Magistrate Judge conducted a hearing, at which I was present and represented by counsel, to determine whether my supervised release should be modified, revoked or terminated. The Magistrate Judge informed me of the following:
(1) Her finding that I violated my conditions of supervised release;
(2) Her recommendation that my supervised release be revoked and that I be sentenced to an additional term of imprisonment;
(3) Her recommendation concerning the additional sentence that should be imposed;
(4) Her reasons for recommending that sentence;
(5) Her intent to issue written findings and recommendation consistent with her pronouncements in open court;
(6) My right to object and obtain the district judge's review of her findings and recommendation; and
(7) My right to appear before the district judge with counsel and to speak on my behalf before sentence is imposed.
[ ] I waive my right to receive and review the Magistrate Judge's written findings and recommendation consistent with her pronouncements in open court before executing this consent and waiver.
[ ] I have now received and reviewed a copy of the Magistrate Judge's written findings and recommendation.
[ ] After consulting with counsel, I HEREBY:
(1) Waive my right to object to the findings and recommendations of the Magistrate Judge;
(2) Consent to revocation of my supervised release;
(3) Consent to imposition of the sentence recommended by the Magistrate Judge; and
(4) Waive my right to be present and speak, and my right to have counsel present and speak, before the District Judge imposes the recommended sentence.
