INDICTMENT

COUNT ONE (Narcotics Conspiracy)

The Grand Jury charges:

1. From at least in or about December 2019 through at least in or about August 2021, in the Southern District of New York and elsewhere, DAVON MIAL, a/k/a "Smooth," the defendant, and others known and unknown, intentionally and knowingly did combine, conspire, confederate, and agree together and with each other to violate the narcotics laws of the United States.

2. It was a part and an object of the conspiracy that DAVON MIAL, a/k/a "Smooth," the defendant, and others known and unknown, would and did distribute and possess with intent to distribute a controlled substance, in violation of Title 21, United States Code, Section 841(a)(1).

3. The controlled substance that DAVON MIAL, a/k/a "Smooth," the defendant, conspired to distribute and possess with intent to distribute was 280 grams and more of mixtures and substances containing a detectable amount of cocaine base in the form commonly known as “crack cocaine,” in violation of Title 21, United States Code, Section 841(b)(1)(A). (Title 21, United States Code, Section 846.)

COUNTS TWO THROUGH SIX (Narcotics Distribution)

The Grand Jury further charges:

On or about the dates listed below, in the Southern District of New York and elsewhere, DAVON MIAL, a/k/a “Smooth,” the defendant, intentionally and knowingly distributed and possessed with intent to distribute a controlled substance, in violation of Title 21, United States Code, Section 841(a)(1):

5. The controlled substance involved in each offense was a mixture and substance containing a detectable amount of cocaine base in the form commonly known as “crack cocaine.” (Title 21, United States Code, Sections 812, 841(a)(1), and 841(b)(1)(C))
