UNITED STATES OF AMERICA v. JOSHUA JERMAINE KINCHEN


RULING

The court has carefully considered the petition, the record, the law applicable to this action, and the Report and Recommendation of United States Magistrate Judge Stephen C. Riedlinger dated May 12, 2014 (doc. 174) to which no objection has been filed.

The court hereby approves the report and recommendation of the magistrate judge and adopts it as the court's opinion herein. Accordingly, the Motion Under 28 U.S.C. § 2255 to Vacate, Set Aside or Correct Sentence by a Person in Federal Custody is DENIED. Further, a certificate of appealability is DENIED forthe reasons set forth by the Magistrate Judge.
