UNITED STATES OF AMERICA, Plaintiff - Appellee, v. JASON CROSS, Defendant-Appellant.

Jason Cross, Appellant Pro Se.

UNPUBLISHED

Submitted: August 29, 2022

Appeal from the United States District Court for the Eastern District of Virginia, at Newport News. Arenda L. Wright Allen, District Judge. (4:14-cr-00003-AWA-LRL-3)

Jason Cross, Appellant Pro Se.

Before KING and AGEE, Circuit Judges, and FLOYD, Senior Circuit Judge.

Affirmed by unpublished per curiam opinion.

Unpublished opinions are not binding precedent in this circuit.

PER CURIAM:

Jason Cross appeals the district court's order denying his counseled motion for compassionate release under 18 U.S.C. § 3582(c)(1)(A) and dismissing his pro se motion for compassionate release as moot.[*] We have reviewed the record and find no reversible error. Accordingly, we affirm the district court's order. See United States v. Cross, No. 4:14-cr-00003-AWA-LRL-3 (E.D. Va. Mar. 17, 2021). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before this court and argument would not aid the decisional process.

AFFIRMED

[*] To the extent that Cross' informal brief constitutes an untimely notice of appeal of the district court's prior June 18, 2020, order denying his motion for a sentence reduction under First Step Act § 404, we affirm the district court's order. Cross was convicted and sentenced in October 2014, and he is not eligible for a sentence reduction under First Step Act § 404. See United States v. Goodwin, 37 F.4th 948, 954 (4th Cir. 2022).
