ORDER

This matter is before the court on the appellant's Motion for Remand. Upon consideration, the court construes the motion as a motion to transfer the case to the United States District Court for the District of Utah. In the interest of justice, the motion as construed is granted. See 28 U.S.C. § 1631. The deadline for the appellant to file his opening brief is vacated. The appeal is transferred to the United States District Court for the District of Utah. This court takes no position on the timeliness issue raised in the appellant's motion.
