ORDER

Upon independent review of the Report and Recommendation of U.S. Magistrate Judge Timothy R. Rice, and the transcript of the guilty plea proceedings, it is ORDERED that the Report and Recommendation is APPROVED and ADOPTED. I accept the guilty plea of Mario Calderon-Medina entered on May 30, 2019. Sentence will be imposed on September 12, 2019 at 9:00 A.M. in Courtroom 14A.

REPORT & RECOMMENDATION

TIMOTHY R. RICE U.S. MAGISTRATE JUDGE

On May 30, 2019, I presided at a guilty plea hearing for defendant Mario Calderon-Medina, who appeared with counsel, Nancy Maceoin, Esq. The United States was represented by Assistant U.S. Attorney Sarah Wolfe. Defendant and counsel consented to have me preside at the guilty plea hearing and file a recommendation on whether Chief Judge Juan R. Sanchez should accept the guilty plea.

I questioned Mr. Calderon-Medina under oath on all topics included in the change of plea colloquy used by the Chief Judge Sanchez, and as required by Fed.R. Crim. P. 11. A transcript of the hearing is available for review.

Based on the sworn answers to the questions posed to Mr. Calderon-Medina, and based on information provided at the hearing by his counsel, and the Assistant U.S. Attorney, I find that:

1. Mr. Calderon-Medina understands the nature of his plea;

2. Mr. Calderon-Medina understands the rights he is waiving, and the consequences of pleading guilty;

3. Mr. Calderon-Medina is competent to enter a plea;

4. Mr. Calderon-Medina has entered a knowing and voluntary plea;

5. Mr. Calderon-Medina understands the elements of the charges and the maximum sentence that could be imposed; and

6. There is an independent factual basis to support the charges.

Accordingly, I respectfully recommend that the Court adopt the Report and Recommendation and accept Mr. Calderon-Medina's guilty plea, as entered on May 30, 2019.
