ORDER TO SHOW CAUSE
The Applicant, Securities and Exchange Commission ("Commission"), having filed an Application for Orders to Show Cause, for In Camera Review, and Requiring Obedience to Subpoena ("Application"), accompanied by the supporting declaration of its staff attorney Richard J. Kutchey, along with the exhibits thereto, a supporting memorandum, and proposed Orders, and the Court having considered the Application and supporting papers, and good cause being shown, it is hereby,
ORDERED, that Respondent Kenneth L. Lay shall appear at 10:00 a.m. on Nov. 7, 2003, before the United States District Court for the District of Columbia, Constitution Avenue and John Marshall Place, N.W.; Washington, D.C., Courtroom 10, to show cause, if mere be any, why he should not be ordered by this Court to produce certain documents to the Commission pursuant to the Commission's subpoena issued on January 2, 2002;
IT IS FURTHER ORDERED, that this Order to Show Cause, together with copies of the Application and supporting papers, be served upon Respondent by representatives of the Commission by facsimile or overnight courier service or other means reasonably designed to give prompt notice of this Order to Respondent no later than October 6, 2003;
IT IS FURTHER ORDERED, that no later than October 21, 2003, Respondent shall deliver to the Commission by facsimile or overnight courier service and file with this Court any statement of points and authorities and other papers in, opposition to the Application; and
IT IS FURTHER ORDERED that no later than October 29, 2003, the Commission shall file with the Court and deliver to Respondent or his counsel by facsimile or overnight courier service any reply papers.
