MEMORANDUM AND ORDER
Pending before the Court is the Motion of United Phosphorus Ltd. for an Order Expediting Discovery (doc. 25). For the reasons stated below, the Motion will be denied.
The Court conducted a scheduling conference in this case with the parties on June 4, 2003 and ordered that all discovery be completed by December 3, 2003. On August 26, 2003, the Plaintiff propounded written discovery in the form of a request for production of documents to Defendants. Along with the written discovery, Plaintiff requested the Court to shorten the response time to a period of fifteen days instead of the statutory period of thirty days.
In support of its motion, Plaintiff asserts that discovery has been stymied due to Defendants' failure to comply with their disclosure objections under Rule 26 and that Plaintiff wants to "get things moving." Notably, however, Plaintiff waited almost three month after the scheduling conference in this matter to initiate the referenced request for documents. Given these circumstances, the Court finds insufficient grounds to reduce the discovery response window.
See Fed.R.Civ.P. 16(b) and 34(b) (granting federal courts broad discretion in controlling the discovery process).
IT IS SO ORDERED.
