Opinion

Case No. 1D00-5088

Opinion filed October 17, 2001.

An appeal from the Circuit Court for Columbia County. Paul S. Bryan, Judge.

Marie Tomassi and Dawn A. Carapella of Trenam, Kemker, Scharf, Barkin, Frye, O'Neill Mullis, P.A., Tampa, for appellant.

David M. Robertson of Brannon, Brown, Haley, Robinson Bullock, P.A., for appellees Thomas W. Brown, William A. Harwell, Joseph W. Harwell, Judith Cara Thompson, Janice H Allen, Henry Birley Harwell, Robert H. Harwell, Margaret Rose Hedgepath, and Peter James Hudson, together with the spouses of each where applicable; Frederick L. Koberlein of Norris, Koberlein Johnson, P.A. for appellees Annie Hudson Clauser and Edgar Clauser, Lake City, for appellees.

Appellant challenges a final order dismissing its foreclosure action with prejudice. We affirm the order as to all appellees except Stanley Waters and Cindi Jo Waters. The record indicates no grounds to have dismissed the case against the Waters; therefore, the order as related to them is reversed.

Appellant's and appellees' requests for appellate attorneys' fees are DENIED.

WOLF, KAHN and BENTON, JJ. concur.
