CONSENT DECREE

MATTHEW F. KENNELLY JUDGE

THIS MATTER, coming on to be heard upon Complaint of Plaintiffs, UNITE HERE HEALTH and MATTHEW WALKER, as fiduciary of UNITE HERE HEALTH (hereafter referred to as the "Plaintiffs") and NEW HARRISON HOTEL CORP., an Illinois corporation, d/b/a TRAVELODGE CHICAGO (hereafter referred to as "Defendant") having been served with a Summons and Complaint on February 1, 2021, have reached a compromise and consent to the entry of this Consent Decree and the Court being fully advised in the premises, enters the following findings and Consent Decree:

1. The Plaintiff Fund is a health benefit plan within the meaning of ERISA, administered within this district. Defendant is an employer that was at all relevant times bound to the terms of a collective bargaining agreement requiring contributions to the Plaintiff Fund, and to the Agreement and Declaration of Trust that govern the Plaintiff Fund.

2. In the interest of resolving this matter without further cost and litigation between the parties, Plaintiffs and Defendant entered into a Settlement Agreement and Mutual Release, signed March Zl, zuil, which requires Defendants to repay an agreed amount over a 12-month period, from February 1, 2021 through January 1, 2022, and provides remedies to the Plaintiffs in the event of a breach, and is hereby incorporated by reference.

3. This Court has jurisdiction over this cause of action and the parties to this Consent Decree.

IT IS, THEREFORE ORDERED, ADJUDGED AND DECREED:

A.. That Plaintiffs, UNITE HERE HEALTH, et al, and Defendant, NEW HARRISON HOTEL CORP., an Illinois corporation, d/b/a TRAVELODGE CHICAGO, have entered into a Settlement Agreement and Mutual Release and,
B, This Court retains jurisdiction of this cause and all the parties hereto for the purpose of enforcing this Consent Decree and the terms of the incorporated Settlement Agreement and Mutual Release.
C. After Defendant makes all payments required by the Settlement Agreement and Mutual Release, any party may move to vacate this Consent Decree and dismiss the underlying lawsuit with prejudice.

WE HEREBY AGREE TO THE ENTRY OF THIS CONSENT DECREE.
