No. 05-03-00736-CV
Opinion Filed August 19, 2003
On Appeal from the County Court at Law No. 4, Dallas County, Texas, Trial Court Cause No. 01-12298-d
DISMISS
Before Justices MORRIS, WHITTINGTON, and RICHTER
MEMORANDUM OPINION
The clerk's record has not been filed in this appeal. The Court received notice on May 20, 2003 from the trial court clerk stating that the record is being held for tender of $40. Appellants failed to respond to the Court's May 22, 2003 notice informing them that arrangements must be made for payment of the record. In a letter dated July 28, 2003, the Court directed the appellants to provide written verification that appellants have made payment arrangements for the record or proof that appellants are entitled to proceed without payment of costs. Appellants were warned that failure to respond would result in the dismissal of this appeal without further notice from the Court.
Additionally, an individual named Ravi Shankar appears to be handling this appeal for both the corporation and for the two individual appellants. The Court's letter of July 28, 2003 informed appellants that legal counsel must be obtained to represent the corporation. See Elec. Data Sys. Corp v. Tyson 862 S.W.2d 728, 737 (Tex.App.-Dallas 1993, no writ). The two individual appellants were instructed that they must be represented by counsel or they must file an amended notice of appeal on their own behalf. Appellants were instructed that without proper legal representation, the appeal would be dismissed without further notice.
The record has not been filed, no verification from appellants regarding the payment for the record has been presented, no notice of legal representation has been filed, and no amended notices of appeal from the individual appellants have been filed.
On the Court's own motion, this appeal is DISMISSED for want of prosecution. See Tex.R.App.P. 37.3; 42.3(b),(c).
