The record in this case was due on March 23, 2023. Appellants failed to make payment arrangements for the filing of the clerk's record and the court issued notice that the appeal might be dismissed unless proof of payment for the clerk's record was provided to the Court by April 26, 2023. Appellants provided proof of payment on April 25, 2023. Appellants also failed to make payment arrangements for the filing of the reporter's record. The Court advised appellants that, unless proof of payment arrangements for the filing of the reporter's record was provided to the Court by April 27, 2023, appellants might be required to file a brief with issues not requiring a reporter's record for disposition. On April 28, 2023, appellants filed a motion for extension of time to file the reporter's record, which the Court granted until August 7, 2023. On December 5, 2023, the Court issued an order requiring appellants to file a brief by January 4, 2024 because the reporter's record had not been filed and no proof of payment had been provided.
On January 18, 2024, appellants filed a motion for extension of time to file the brief, attaching a copy of a check for payment for the reporter's record. Appellee has filed a response opposing the motion for extension. The Court has reviewed this response.
The motion for extension is denied. The reporter's record is due on February 22, 2024. Appellant's brief is due 30 days after the reporter's record is filed. See Tex. R. App. P. 38.6(a).
