MOTION DECISION

Present - Hon. Rolando T. Acosta, Justice Presiding, Jeffrey K. Oing Anil C. Singh Lizbeth González Julio Rodriguez III, Justices.

An appeal having been taken to this Court from an order of the Supreme Court, New York County, entered on or about October 15, 2021,

And plaintiffs-appellants having moved for a preliminary injunction directing the AAA to suspend the invoice with a due date of October 14, 2021 and enjoining the closure of the arbitration files pending hearing and determination of the aforesaid appeal, And an interim stay of movant's time to pay the aforesaid invoice having been granted by order of a Justice of this Court dated October 20, 2021, conditioned on movant paying AAA the sum of $700,000 to cover the cost of arbitrator appointment, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is granted on the condition that plaintiffs-appellants perfect the appeal for the March 2022 Term of this Court and upon the condition imposed by the Interim Order of a Justice of this Court dated October 20, 2021.
