ORDER
By Order dated March 6, 2002, this Court appointed Neal H. Klausner, Esq., special master to determine, with respect to each work upon which plaintiff sues in this action, whether the work is the subject of a valid and subsisting copyright registration, the nature of plaintiff's interest if any in the work, and whether the plaintiff has standing to sue for infringement of any copyright in the work as well as any related questions that may bear on the determination of these issues.
The special master filed his report and recommendation and served notice of filing thereof on May 22, 2002. No objections have been filed thereto. The Court today confirmed with counsel for both sides, at a pretrial conference, that neither side has any objections to the report and recommendation.
Accordingly, the Court hereby finds as follows:
1. Plaintiff is the owner of, or possesses the power of attorney for the enforcement of, certain trademarks that appear on all of the works identified in Exhibit A to the report and recommendation of the special master (the "RR") except for certain copies of the works that were seized before defendants had completed the alleged copying of the work.
2. Plaintiff has standing to sue for copyright infringement with respect to the works set forth on Exhibit D to the RR.
3. Plaintiff does not have standing to sue for copyright infringement with respect to the works set forth on Exhibit E to the RR.
