ORDER


Plaintiff, Richard Tyler, an inmate at the Iron County Correctional Facility, filed a pro se civil rights complaint and was granted leave to proceed in forma pauperis. See 42 U.S.C.A. § 1983 (West 2003); 28 id. § 1915(b). On March 26, 2004, the Court ordered Plaintiff to within thirty days submit to the Court an initial partial filing fee of $2.50, a consent to collection of the remaining filing fee from his inmate account, and a certification that he has exhausted his claims in the prison grievance system. Although Plaintiff has offered some excuses regarding his failure to exhaust, Plaintiff has not at all complied with the Court's earlier order.

IT IS THEREFORE ORDERED that Plaintiff's complaint is dismissed without prejudice.
