Dec 7, 1990
570 So. 2d 1119 (Fla. Dist. Ct. App. 1990)

Opinion

No. 90-00897.

December 7, 1990.

Appeal from the Circuit Court for Hillsborough County; Harry Lee Coe, III, Judge.

James Marion Moorman, Public Defender, and Kevin Briggs, Asst. Public Defender, Bartow, for appellant.

Robert A. Butterworth, Atty. Gen., Tallahassee, and William I. Munsey, Jr., Asst. Atty. Gen., Tampa, for appellee.

We affirm the appellant's convictions but reverse the guidelines departure sentence because the sentencing judge failed to give written reasons for departure. Pope v. State, 561 So.2d 554 (Fla. 1990). We remand for resentencing within the guidelines.

LEHAN, A.C.J., and HALL and PARKER, JJ., concur.
