ORDER ADOPTING REPORT AND RECOMMENDATION

Tana Lin, United States District Judge.

The Court, having reviewed the Report and Recommendation of Magistrate Judge David W. Christel, objections to the Report and Recommendation, if any, and the remaining record, does hereby find and ORDER:

(1) The Court adopts the Report and Recommendation.

(2) Plaintiff's motion for summary judgment (Dkt. 75) is denied.

(3) Defendants' motion for summary judgment (Dkt. 78) is granted. Plaintiff's claims against the “John Doe” defendants are dismissed without prejudice; plaintiff's 42 U.S.C. § 1983 claims against all remaining defendants are dismissed with prejudice; and this case shall be closed;

(4) To the extent that plaintiff purports to bring a claim pursuant to RCW 72.09.135, the Court declines to exercise its supplemental jurisdiction over such claim.

(5) The Clerk is directed to send copies of this Order to Plaintiff, counsel for Defendants, and to the Hon. David W. Christel.
