Petitioner's seriatim Opening Brief was due on July 31, 2023. The Court held a teleconference with the parties to discuss petitioner's failure to file his Opening Brief. Petitioner asked for an extension of time to file. The Court extended the time to September 19, 2023, for petitioner to file his Opening Brief. Due to petitioner's failure to comply, it is

ORDERED that petitioner is precluded from filing his seriatim Opening Brief. It is further

ORDERED that answering briefs are no longer required. It is further

ORDERED that the Court will, until November 24, 2023, refrain from proceeding on this case and, on or before that date, respondent shall file any appropriate dispositive motion.
