On order of the Court, the motions for immediate consideration are considered, and they are GRANTED. The motion for stay of proceedings is considered, and it is DENIED. The application for leave to appeal prior to decision by the Court of Appeals is also considered, and it is DISMISSED AS MOOT. On April 11, 2002, the Court of Appeals dismissed respondent's claim of appeal for lack of jurisdiction on the ground that the trial court's February 13, 2002, order was not a final order. The Court of Appeals order states that respondent may file a claim of appeal from the trial court's April 3, 2002, final order. Thus, any consideration by this Court of respondent's arguments in the present application would be premature.
