ORDER MODIFYING OPINION AND DENYING PETITION FOR REHEARING

BEDSWORTH, ACTING P. J.

It is ordered that the opinion filed herein on March 1, 2011, be modified in the following particulars:

1. On page 9, in the last full paragraph which begins “The rudiments of a claim” remove the word “discernable” and replace with “discernible.”

This modification does not effect a change in the judgment.

Appellant’s petition for rehearing is DENIED.
