Tudor Insurance Co. v. McKenna Associates

United States District Court, S.D. New York
Dec 13, 2000
00 Civ. 8770(LAK) (S.D.N.Y. Dec. 13, 2000)

Opinion

00 Civ. 8770(LAK).

December 13, 2000.

ORDER

The complaint does not adequately allege the nature or citizenship of defendant McKenna Associates and therefore does not allege facts which, if proved, would establish the existence of subject matter jurisdiction. Nor has plaintiff cured this defect despite the Court's having directed it to do so by order dated November 27, 2000. Accordingly, the action is dismissed for lack of subject matter jurisdiction.

SO ORDERED.
