Opinion

No. 3D01-1968

Opinion filed January 16, 2002.

An Appeal under Fla.R.App.P. 9.141(b)(2) from the Circuit Court for Miami-Dade County, Lawrence Schwartz, Judge. Lower Tribunal No. 96-26304.

Dyron Tucker, in proper person.

Robert A. Butterworth, Attorney General, and Barbara A. Zappi, Assistant Attorney General, for appellee.

Before FLETCHER and SORONDO, JJ., and NESBITT, Senior Judge.

Because Appellant is incarcerated under more than one case number, the state concedes that this case should be remanded with directions to the trial court to determine the exact amount of credit for time served that Appellant should be awarded in case number, 96-26304. If such a determination cannot be made upon review of court and jail records, an evidentiary hearing will be conducted.

Reversed and remanded with instructions.
